An attorney’s job in criminal case is to get the best result for his or her client. An acquittal, a dismissal, or a lesser punishment when the facts and law are stacked against the client are ways in which attorneys attempt to accomplish this. One seldom used but available avenue for getting a great result for a client, is a motion to dismiss. A motion to dismiss filed under Rule 3.190 is a pretrial mechanism to terminate a criminal prosecution without the need for extensive or costly (emotional or financial) litigation.

Under Rule 3.190(c)(4), Florida Rules of Criminal Procedure, a defendant may, at any time, file a motion to dismiss on grounds that there are no disputed issues of material fact in the case and the undisputed facts do not amount to a prima facie case of guilt.

In this type of “C4” motion, the defendant alleges that the State and defense agree on the essential facts involved in a case and, even if those facts are taken as true, they do not amount to a criminal offense. The court can therefore intervene to make a legal ruling on the issue without weighing evidence or determining factual matters.

Having the right attorney who knows if and when to file a C4 motion to dismiss could make the difference between your loved one having to face a Jury or a Judge and the added stress and expense of a trial or having the case against him or her dismissed without the need for a trial, which is always a roll of the dice.

On today’s date, March 22, 2018, after more than 3 years litigating a grand theft case in which 4 co-defendants were convicted, the state, unable to traverse the C4 motion I filed on behalf of my client, was forced to nolle prose (dismiss) the case!

You show up ready for trial after dismantling the state’s case for the past two and a half years, and you hear the state mumble in Case F15-xxxx the state announces a nolle prosse. The charge of actual possession of a firearm by a convicted felon, which carries a three year minimum mandatory sentence, is dismissed.

Your client who really has turned his life around but is nevertheless a career criminal, (because he didn’t always make good choices) knows that he has a chance of spending the next 3 to 15 Christmas’ and New Years’ with his wife and kids thanks to his attorney. That really is the reward. Those are the victories that every attorney lives for.

Two years ago today I started my own firm, not just because I realized a long time ago that I just don't like working for "the man" or depending on others for a paycheck. I started my own firm because I truly enjoy the flexibility of being my own boss and because I love the law and didn't want to be confined to areas of law that the firms I worked for specialized in. Running any business isn't easy, especially when it comes to a law firm. It takes hard work and dedication and requires a certain degree of focus. Being a good attorney or even a great one isn't enough. Getting good results isn't enough to guarantee success. You have to be a good business person as well. Most of the best artists of all time couldn't generate enough revenue from their art during their lifetimes to live a good, comfortable life. To run a law firm you have to know or learn very quickly how to generate income, keep costs low and how to market yourself. You also have to be a good attorney. Of course, there is always a little element of luck. Most importantly you have to believe and have faith in yourself.

Having the right attorney can make all the difference in the world!

The client a young girl with no criminal history was charged with several counts of accessory after the fact to felony murder in Miami Dade County; a father's worst nightmare! The state charged her and made a written plea offer to testify against the would be murderer her ex boyfriend and receive a withhold of adjudication to the felonies with straight probation with a potential 10 year prison sentence for violating any provision of the plea agreement! The state's best argument, could not exclude my client's reasonable hypotheses of innocence that she lacked knowledge that a murder had had occurred and that she knowingly assisted the would be killer with the intent that he escape arrest or prosecution. After filing a C4 sworn motion to dismiss all charges, admitting all of the facts as alleged by the state and all reasonable inferences that could be drawn from the evidence in the light most favorable to the state, the state dismissed the case while then potential dismissal of the charges by the court loomed large.
